Title II
Prohibits discrimination against qualified individuals with disabilities in all programs, activities, and services of public entities.
Title IX
Prohibits harassment and discrimination on the basis of sex. Individuals may not be excluded from participation, or be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.
CRR Title 5
Prohibits discrimination, harassment, or any other form of illegal bias against an individual. No person shall be excluded from participation in or denied the benefits of any local agency's program or activity on the basis of sex, sexual orientation, gender, ethnic group identification, race, ancestry, national origin, religion, color, or mental or physical disability in any program or activity conducted by an “educational institution.”
Section 504
Section 504 of the Rehabilitation Act of 1973 provides equal access to education by providing accommodations for students identified with a disability that substantially limits one or more life activities even if they are not eligible for special education services. Further, Section 504 prohibits discrimination against students with disabilities in LEA programs, gives parents/guardians rights to examine relevant records, to participate in an impartial hearing including the opportunity for representation by counsel and a review procedure.
