Q: What is the CSEA Juneteenth settlement?
A: A class action settlement was approved by the Alameda County Superior Court on November 21, 2024, and it affects CSEA members (only) for Juneteenth in 2021, 2022, and 2023. Q: Who is eligible for the settlement?
A: For 2021 Claims: Eligible employees worked or used available paid leaves (vacation or sick) on June 18, 2021; held a position in the CSEA represented bargaining unit on June 18, 2021; currently hold a position within the CSEA represented bargaining unit; and must submit the claim form by February 19, 2025.
For 2022 Claims: Eligible employees worked or used available paid leaves (vacation or sick) on June 20, 2022; held a position in the CSEA represented bargaining unit on June 20, 2022; currently hold a position within the CSEA represented bargaining unit; and must submit the claim form by February 19, 2025.
If you did not work on June 18, 2021 or June 20, 2022, or were not on an approved paid leave, you are NOT ELIGIBLE.
Q: Why is KHSD not paying for 2023 or beyond?
A: KHSD negotiated Juneteenth as a holiday and has recognized it since 2023. Accordingly, KHSD is only required to compensate CSEA employees/retirees who worked on Juneteenth in 2021 and 2022.
Q: What if I retired from KHSD, am I still eligible for compensation?
A: Maybe. The Settlement Agreement defines retired individuals who are eligible for compensation as former employees, who were CSEA members when employed, who actually worked on July 18, 2021 and/or July 20, 2022 and were also in paid status the workday before or after those dates, who retired as of March 1, 2024, and who continue to be members of CSEA in the CSEA Retiree Unit as of November 21, 2024.
Q: What if I quit or was terminated from KHSD, can I still make a claim for compensation?
A: Not likely. However, CSEA has set up a special email for members to make inquiries. It is [email protected] Be sure to include your employer name (KHSD) and/or your CSEA chapter number. You may also call your CSEA labor relations representative or CSEA at 1-866-487-2732.
Q: What is the settlement amount?
A: KHSD will compensate all eligible employees/retirees who timely submit a claim form and sign the required waiver with the actual wages the employee earned on June 18, 2021 and/or June 20, 2022, less customary and regular payroll deductions.
Q: Why isn’t my union group included in the settlement?
A: CSEA (only) filed a class action lawsuit which resulted in this settlement for CSEA members, only. KHSD’s CSEA groups that are included are CSEA Chapters 81, 747, and 901.
Q: Will raises from 2023 or 2024 be applied to my claim funds?
A: No. You will be compensated the exact wages you actually earned in 2021 and/or 2022, and no negotiated changes in compensation will apply to the settlement funds.
Q: Can I get compensatory time (“comp time”) instead of a payment?
A: No. The settlement gives school districts the option to choose payment or comp time and KHSD is paying these claims monetarily, only.
Q: Can I get my money early?
A: No. KHSD will process all claims and send out determinations and payments at the same time. Please do not contact HR to inquire about your anticipated payment date as all claims will be processed together in Summer 2025.
Q: How do I get started so that I can receive compensation?
A: Please refer to the “KHSD Juneteenth Process” on this website that outlines all of the required and time sensitive steps you must take in order to be eligible. See above.
Q: I have not received an eligibility determination letter, who should I contact?
A: Please check your mailbox, but if you have not received a letter within two weeks of April 21, 2025, please email [email protected].
